What To Expect During The Divorce Process

The divorce process can be very emotional and has the potential to be tricky. Each divorce will have its own unique circumstances and will need to be treated as such. Even though each divorce is unique, there are some main pillars that will need to be addressed throughout the process. Having the right divorce attorney by your side will help you manage each of these pillars and will help you manage the stress of planning these out.

  • Child Custody & Parenting Time: One of the biggest items to address in the divorce process is child custody and parenting time. When addressing this item, it is important to consider your child’s happiness and stability. It will be important to figure out legal custody of your child and to figure out a parenting schedule that works for everyone.
  • Property Division: Another item that will need to be addressed in the divorce process is which assets and debts are marital and non marital. A non marital asset is considered something that was owned before the marriage or was inherited.
  • Child Support: The amount of child support necessary will typically be determined by the state guidelines. These guidelines take into account each parent’s income and what the parenting time arrangement is.
  • Spousal Support: Alimony is something that is used to assist one spouse with their monthly living expenses. This is something that will need to be considered when one spouse has the financial ability to support the other.

Contested vs Uncontested Divorces In Texas

Contested and uncontested divorces will follow very different processes. Understanding the difference between the two types of divorces will help you know which path your matter will likely go down.

  • Contested Divorce: Contested divorces occur when you and your spouse are not in agreement on some items in your divorce. Some of these items are child custody, parenting time, child support and spousal support. Contested divorces tend to have higher attorneys fees because there will be a need for a negotiation and potential litigation to come to a resolution.
  • Uncontested Divorce: Uncontested Divorces tend to be a much easier process and can have lower attorneys fees. This form of divorce is easier because you and your spouse would have already reached an agreement on child custody, parenting time, child support and spousal support.
